KARACHI: Eight Special Customs Reference Applications filed by Sheikh Pipe Mills and others were remanded back to the Custom Appellate Tribunal for deciding the same afresh and under a well reasoned order.
Imran Iqbal Khan Advocate appeared for the applicants while respondent customs department was represented by Sardar Zafar Hussain Advocate.
The SHC observed that perusal of the judgment by tribunal reflects that tribunal failed to give any reasoned finding and dismissed the appeal by merely observing that the order of the Collector of Customs (Appeal) Karachi is well reasoned.
The bench reached to a contrary conclusion and find tribunals order itself as devoid of sound reasons and thus while setting aside impugned judgment ordered Tribunal to decide the matter afresh and pass a well reasoned order.
