KARACHI: Notices were issued to the Pakistan Customs and other respondents for 28.11.2024 in two identical petitions filed by Muhammad Waseem Bhalli and Muhammad Imran Bhalli through renowned law firm Franklin Law Associates.
Earlier the counsel from the law firm submitted that three consignments of each petitioner were assessed and released with a message of “Gate Out”. However the importers got a message of reassessment on the basis of some SRO for recovery of Additional Custom Duty (ACD) levied at a rate of 11 per cent. The counsel submitted that this was being done without issuance of any Show Cause Notice which action is therefore unlawful and lacks jurisdiction.
The counsel from Franklin Law Associates argued that this controversy has already been decided by the SHC in a case known as Harris Silicones & Glass.
The bench after hearing initial arguments while ordering issuance of notices to the respondents restrained them from taking any coercive action against the petitioners till next hearing.
