KARACHI The order of Federal Tax Ombudsman (FTO) directing Collector of Customs Appraisement West to release goods provisionally was suspended by a custom Appellate bench of High Court of Sindh after able assistance of Sardar Zafar Hussain Advocate, counsel for the petitioner Collectorate.
As per details, Universal Auto Engineering filed a complaint before the FTO that custom valuation is not considering valuation by the importer and instead assessing the imported goods nuts, bolts and washers are made of High Tensile material.
The FTO after hearing the complainant side made two recommendations.In first recommendation Director General Valuation was asked to direct the Director Valuation for issuing new VR after affording opportunity of being heard to all stake holders in second recommendation Collector of Customs Appraisement, West was ordered to provisionally release goods.
The second recommendation was considered and as per advise of counsel the Collector Appraisement West filed a constitutional petition before High Court of Sindh.
Sardar Zafar Hussain Advocate representing petitioner today argued that Director General Valuation has settled the issue by ordering Director Valuation to issue a new VR as per law and while deciding Review petitions and revisions has ordered that present VR will hold field till new VR is issuedÂ
The counsel maintained that in view of fact that VR is in field, the order of FTO is beyond jurisdiction.
As Sardar Zafar Hussain Advocate canvassed case of Collector with remarkable arguments, the bench suspended the order of FTO while ordering issuance of notices to respondents as well as Deputy Attorney General for Pakistan for 2-12-2024.
