KARACHI: A custom appellate bench of High Court of Sindh adjourned hearing of a constitutional petition filed by Messer’s RTW Shipping & Logistics Private Limited seeking permission to re-export 5 shipments of Black Tea.

The bench heard the counsel for petitioner who submitted that petitioner seeks direction to the custom authorities concerned to decide application filed under section 139 of the Customs Act 1969.

Sardar Zafar Hussain advocate, appearing for the Collectorate concerned filed comments and opposed the plea of petitioner. He informed the bench that lawful importers namely Messer’s Star Corporation and Reliance have filed Goods Declaration for Home Consumption and in view of GDs, the petition is not maintainable.

The bench after hearing the sides directed the Custom department to decide application under section 139 in accordance with law. The bench also ordered that Respondent no 3 & 4 who are importers if fell aggrieved by such order, they can avail remedy available to them.
