KARACHI: The order passed by the Customs Appellate tribunal shall be implemented immediately ordered a custom appellate bench of High Court of Sindh comprising Justice Muhammad Junaid Ghaffar and Justice Adnan-ul-Karim Memon. The bench was hearing a constitutional petition filed by M/s Shaheen Freight Service through counsel Rana Shakawat Ali Advocate.

The respondent department/custom collectorate was represented by Imran Ali Mithani Advocate who was said to be out of station as court was informed by  one Zohaib Alam. The bench noted that a connected SCRA is also pending which was filed after mandatory period of appeal. The bench also found that no restraining order was obtained by the department but yet order of the Custom Appellate Tribunal passed two year back was not implemented.

The bench deciding the petition dismissed the SCRA as being time barred while ordering immediate implementation of order of the tribunal. It further ordered that in case of non-compliance, the respondent custom officer shall be in attendance on 4.3.2024, next date of hearing.
