KARACHI: Pre admission notice was issued for Feb 01 in a petition challenging bar on provisional release of items in case of dispute over valuation.
The impunged 3rd Proviso was added to Section 81 of the Custom Act 1969.
The petition was filed by Shamim Enterprises, Karachi. Rana Sakhawat Advocate appeared for the importers
He submitted that the Valuation Ruling 1668/2022 in respect of Hot Melted Adhesive in different forms wash challenged before the competent authorities and heir archy of Pakistan Customs and Order in Revision was challenged before Custom Appellate Tribunal.
He further submitted that Custom Appellate Tribunal as well as custom authorities declined pray for provisional release of imported goods which is denial of fundamental right of petitioners.
The bench after hearing initial arguments observed that points raised in prayer needs consideration. The bench then ordered issuance of pre-admission notices for Feb 01.
