ISLAMABAD: Islamabad High Court has dismissed a petition filed by Pakistan International Airlines Corporation Limited (PIACL) challenging the vies of Section 14-A (2) of the Customs Act 1969 while petitions filed by a number of importers of arms were allowed.
Muhammad Waqar Rana Advocate represented PIAC while Adnan Haider Randhawa appeared for the importers.
As per details the consignments of arms imported by the petitioners were confiscated. The same were ordered to be released after a prolonged litigation. The custom authorities issued Delay & Detention Certificate in respect of such consignments which was not complied by the PIAC.
The bench heard the counsels at length and reached the conclusion that PIAC has no statutory authority to re-adjudicate the matter. With the above observation the IHC bench dismissed the petition by PIACL while it allowed the petitions by importers and ordered the PIACL to comply with the Delay & Detention Certificate and release the goods without any delay.
