KARACHi: Two connected petitions pertaining to controversy over import of construction vehicles fixed for hearing on 30 Nov 2022 will now be heard on 1-12-2022 as Senior Advocate Salman Akram Raja sought change due to appearance before Supreme court.

Appearing for petitioner Haji Abdul Razik who is seeking release of hundreds of vehicles under previous import policy, counsel has filed an urgency application.
Salman Akram Raja at the outset maintained that despite notices respondent custom authorities are going to conclude adjudication proceedings and are bent upon causing serious financial injury to petitioner while apex court has taken note of frivolous litigation in which Petitioner has been dragged by Pakistan Custom. He referred to an order in Civil Pet 1941/2022 titled Haji Abdul Razik versus Director, Directorate of Intelligence & Investigations in this regard.

Khalid Rajper, counsel for Pakistan Customs in related petitions controverted the submissions and stated that agreement of 2009 under which vehicles have been imported and clearance is being sought has been declared illegal and unlawful by apex court in 2014. Khalid Rajper also questioned the maintainability of petitions. The counsel for petitioner at this stage requested for ante dating as he will be busy before Supreme court on 30 Nov 2022.

The bench changed date if hearing to 1-12 2022 restraining respondent customs from passing any adverse order till then while Petitioner was directed to file the response to Show Cause Notices.
