KARACHI: The chairman FBR, Collector of Customs, East and Deputy Collector Group VII on notice for Nov 15 in a petition challenging notice for recovery issued to Messers Umer Spinning Mills (Pvt) Ltd.

The order came from custom appellate bench of High Court of Sindh which was apprised by a counsel from renowned law firm Franklin Law Associates that impugned notice was issued eight months after goods were out of charge by the DC Group VII. The notice is illegal on the face of it, the counsel representing the petitioner company submitted while relying on decision given in a petition tiled Shoe Planet (Pvt) Ltd Versus Collector of Customs, MCC Appraisement, East.

The counsel also submitted that ground on which impugned notice is issued has been decided in another petition title Aisha Stell Mills versus Federation of Pakistan 2011-PTD 569.

The bench after hearing the counsel from Franklin Law Associates ordered issuance of notice to the respondents for Nov 15.
