KARACHI: Notices were issued to importers of Concrete Mixer/Construction Vehicles for Nov 15 while implementation of order of Custom Appellate Tribunal was stayed.

The bench earlier heard Khalid Rajpar advocate representing MCC Hyderabad.
The counsel said that 36 vehicles under dispute are not covered under the order of Custom Appellate Tribunal as these are under new Bill of Ladings.

He convassed the case history and said respondent import entered into a contract with Dubai based company in 2013 which was later renewed in 2014 and 2000 units were purchased against price of US$ 15 Million. He submitted that under Import policy order vehicles older than five years are not importable while these vehicles are from model 1995 to 2000.

Khalid Rajpar advocate further conteded that order of Custom Appellate Tribunal is beyond jurisdiction and does not pertain to subject 36 vehicles as order passed for previous consignment could not be taken as “perpetual”, hence not implementable.

He prayed for a stay order which the custom Appellate bench allowed ordering notice to importer for Nov 15.
