KARACHI: Deciding a controversy regarding GD for Home Consumption by a company registered in Jamrud, Khyber Pukhtoon Khawa, a custom appellate bench of High Court of Sindh allowed the petitioner company Alpha Polymer to filed a Transhipment (TP) GD.
The bench heard arguments by Imran Iqbal Khan Advocate who first sought directions to Pakistan Customs for allowing a GD of Home Consuption while relying on order of SHC in CP-D- 6300/ 2021 vide order dated 28-2-2022.
Khaild Rajper Advocate appearing along with Principal Appraiser (Law) of Port Muhammand Bin Qasim COllectorate opposed the plea on ground that case of the petitioner is on different pedestal.
The counsel for petitioner then submitted that GD for home consumption was filed as road network was devastated due to heavy rains but now the network has been rehabilitated TD GD may please be allowed.
The bench agreeing with the contentions of the counsel for petitioner company allowed the filing of TP GD as contended by both the sides in peculiar circumstances.
The bench disposed of the petition with the direction to the petitioner to submit bank guarantees with Nazir of SHC while custom authorities were asked to adhere to CGOs issued from time to time by Federal Board of Revenue.
