KARACHI: An appellate bench of High Court of Sindh has restrained the Inland Revenue department from forced recovery of Income Tax from Mekotex Pvt Ltd, Landhi, Karachi.

The bench heard Muhammad Hassan Advocate appearing for the petitioner company and Ms Afhseen Aman Advocate representing Commisssioner of Appeal-I (IR) and Deputy Commissioner-IR, Unit 8, Enforcement I, LTO, Karachi.

The counsel said that appeal by the company is pending adjudication while the department has initiated recovery proceedings. He referred to a number of identical matters which have been disposed off with the direction to the respondents to pending appeal.

As the counsel for respondent IR department conceded this fact, the bench disposed of the petition with the direction to the respondent Commissioner Appeals to decide the same within 60 days from the date this order is passed. Till then no coercive action shall be taken against the petitioner company, the bench ordered.
