KARACHI: An appellate bench of High Court of Sindh seized with the hearing of custom, sales tax and income tax matter is discouraging the un-necessary litigation’s.

The bench in a recent hearing asked the lawyer from a noted law firm that whether they have replied to the show cause notice issued to them by the department concerned.

By not responding to the show cause, you are subscribing to what is stated in the show cause notice. This will not go in your favor, the bench said. The bench then called Deputy Attorney General Kafeel Ahmed Abbasi to the rostrum and told him to assist the court.

The bench later disposed of the petition with directions to the petitioner side to approach the department, reply to the show cause. If orders comes against you, an appeal lies and any of the party could exercise the right of the appeal, the bench said parting with the order disposing of the matter.

The similar approach could be seen in cases where the petitioners came directly to the court without exhausting alternate remedy or remedy before the department.

This would lead to curtail the number of new cases filed every day and make the department work strictly as per law. The litigants were also made to take legal course and approach the superior court if all remedies are exhausted and matter remain un-resolved on merit.
