KARACHI: The Special Custom Appellate Tribunal (SCAT) dismissed an appeal filed by Agriauto Stamping Private Limited against Order in Original passed by Coector Adjudication II, Karachi.

According to respondent Directorate of Intelligence & Investigations, on a tip off detained a consignment of Catalyst used in vehicles. The importer was allegedly used to get consignment cleared at Zero rate while other importers are paying at a rate of 20 per cent of value.

The importer challenged the allegation of misdeclaration of PCT heading before the Adjudication Collectorate which ruled in favor of the department and importer was asked to pay duty and taxes worth Rupees 1000 million besides payment of fine and other payables. The importer company challenged the Order in original before the SCAT.

Omar Shafiq Ad Drditional Director and Ilyas Ghickhi Appraising Officer represented the Directorate of I&I and established misdeclaration of PCT heading.The SCAT after detailed hearing dismissing the appeal said in order that it found no reason to interfere with the Order in Original. The SCAT however waived the fine and penalty imposed on the importer while ordering payment of duty and taxes as per applicable PCT heading 8421-9000.
