KARACHI: Taking a strict notice of non implementation of Section 81 of Customs Act 1969 which provides for provisional release of imported items if any dispute arises over Valuation or else, a custom Appellate bench of High Court of Sindh ordered DC East of Pakistan Customs to appear on June 13.

The bench earlier heard Rana Sakhawat Advocate representing MAT Enterprise which imported a consignment of PVC Floor Tiles/mats.

The bench observed that in the presence of a number of judgments including leading judgment known as Danish Jehangir case, the custom officials shall allow provisional release without any delay.

The bench expressing displeasure over non compliance of judgments holding field and while observing that once Valuation Ruling 1622 of 2022 was under challenge, why provisional release was denied forcing importer to enter into litigation.

The bench then ordered that on June 13, next date of hearing an officer not belie the rank of Deputy Collector shall be in attendance.
