KARACHI: As an interim relief, a custom appellate bench of High Court of Sindh allowed provisional release of imported chip board and sheets.
The bench was hearing a petition filed by Messer’s MRC Enterprises through Franklin Law Associates. A counsel from the reputed law firm appearing before the bench stated that consignments imported by them are at port due to a classification dispute. He further submitted that adjudication proceedings are pending and during pendecy, petitioner is willing to secure differential amount of duty and taxes.
The bench as an interim relief allowed the request and asked the petitioner to secure undisputed amount of duty and taxes with the department while disputed amount be secured with the Nazir of the court who will invest the same in some profitable scheme if the Government.
The Nazir was also asked to issue an appropriate certificate at which forthwith release of goods was ordered.
The bench made the fate of such secured amoubt to decision of the adjudicator.
