KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Zulfiqar Ahmed Khan and Justice Adnan Iqbal Chaudhry disposed of a petition filed by Messers Arbab Tradiers  directing the customs authorities to released goods on securing of un-disputed amount of duty and taxes.

The bench earlier heard a counsel from Franklin Law Associates representing the petitioner who contended that an application under section 25-D of the Customs Act 1969 has been filed against the impugned Valuation Ruling (VR) 1570 of 2021 dated 25-11-2021 before the Director Valuation. He expressed willingness on the part of the petitioner to secure the differential amount with the Nazir of SHC. The bench then heard arguments by Irfan Mir Halepota, representing the Directorate of Valuation.

The bench  later ordered “forthwith” release of the consignment affer securing undisputed amount with the collectorate concerned and disputed amount with Nazir of SHC. The bench also held that as the release was delayed due to fault of the department, no charges including demurrage or detention would be charged from the importer/petitioner.
