KARACHI: Pre-admission notices were issued to the Collector, Assistant Collector, MCC Appraisement, East and Director General Valuation for Feb 01 in a constitution petition filed by

M/s Saleem Traders Industry & others.

The petitioner challenged the valuation of imported goods on the basis of Assessment Alert instead of Valuation Ruling issued under section 25 of the Customs Act 1969.

The petitioner prays that Assessment Alert/Valuation guideline dated 22-11-2021 issued by the Director General Valuation, Pakistan Customs as illegal, without jurisdiction and of no legal effect. The petitioner also seeks a direction to the respondents to assess the subject consignments strictly in terms of procedure provided under section 25 of the Customs Act 1969 without being influenced by the impunged Assessment Alert. It was further prayed that the respondents be directed to release the consignments of petitioners lying at the port on the declared value as per PRAL data and to issue delay and detention certificate.

The bench after hearing initial arguments by counsel from Franklin Law Associates ordered issuance of pre-admission notices to the respondents for Feb 1.
