KARACHI: A single bench of High Court of Sindh (SHC) ordered issuance of notice to the defendants for January 13 to the defendants including Secretary Commerce, FPCCI, DGTO, Shams Burney, Secretary General All Pakistan Customs Agents Association and others.
The bench earlier heard counsel for the respective sides. The counsel for the plaintiff sought a declaration regarding inclusion of the names two defendants, Syed Shams A Burney and another in the final voter list to be held today (30-12-2021) as un-lawful.
The plaintiff also sought declaration against Secretary FPCCI and Order in Original (ONO) passed by Director General Trade Organizations (DGTO) dated 03-12-2021.
The counsel for plaintiff also referred to a restraining order passed by SHC in Suit 2051/2021.
The bench after hearing the defendant sides ordered issuance of notices to Attorney General Pakistan as well as defendants for Jan 13 seeking written statements as well as counter affidavit or written reply.
The bench however declined to stay elections of FPCCI but ordered that votes casted by the two defendant members be sealed and kept separate with these votes “subject to the orders of SHC”.
