KARACHI: Entertaining a plea filed by the Jumbo International, a clearing agent, a bench of High Court of Sindh while issuing pre-admission notices for Jan 12, 2022 restrained Collectors of MCC East and West from taking any coercive action against plaintiff till next date of hearing.
The plea was filed through Franklin Law Associates and a counsel from the law firm representing the clearing agent submitted that their client following routine procedure filed GDs for vehicles released under Appendix–E of the Import Policy Order 2020 after completion of all codal formalities including the newly added sub paragraph (6) of paragraph 3 of the Appendix quoted above.
It was further contended that plaintiff / applicant arranged foreign exchange supported by bank encashment certificates showing foreign remittances converted into local currency.
The counsel submitted that Collectorates of East and West have recently commenced an operation against certain imports alleging that vehicles were released in violation of para 6 of Appendix E of the Import Policy Order 2020. It was maintained that they have no concern with the advertisement as their consignments have been released as per law. The counsel expressed apprehension that action may be taken against plaintiff/applicant by blocking CNIC or License, User ID etc.
The bench after hearing the counsel for Jumbo International ordered issuance of pre-admission notices to the other side for Jan 12, 2022.
