KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Rashida Asad disposed of a petition filed regarding released consignments of petitioner companies.

The petition was filed by A.R.Industries,  Patanwala Traders, Brother Enterprise and S.M.Industries through Khawaja Shamsul Islam Advocate.

The Collector Customs, Appraisement, East, Chief Collector South Surraya Butt, Additonal Collector Appraisement, Examination, Additional Collector, Appraisement, East, Deputy Collector Examination East etc. Khalid Rajpar Advocate represented Directorate of Intelliegence & Investigations, MCC West and East.

Earlier Khawaja Shamsul Islam appearing for the petitioners filed a statement and informed the bench that the petitiones have been acquitted by the Special Judge, Customs and Anti Smuggling Court.

Khalid Rajpar submitted that the orders of the court in this petition have been complied and consignments pertaining to GDs have been released after securing securities of disputed amount with the Nazir of the court.

He also submitted that adjudication proceedings have been concluded and Order in Original has been issued. The petitioners have the remedy of challenging ONO before the Special Customs Appellate Tribunal, counsel for Pakistan Customs submitted.

The counsel for SAPT also sought orders for payment of demurrage etc. The bench after hearing all the sides ordered that encashment, release of demurrage  etc are conditional to the outcome of order of the tribunal. The bench further observing that the instant petition has served its purposed disposed of the same.
