SHC disposes of suits setting Customs free to proceed with SCNs

KARACHI: A Custom Appellate bench of High Court of Sindh (SHC) disposed of two suits after counsel for plaintiff side submitted a statement for disposal.

The bench disposing off Suit no 723 and 724 of 2021 set Pakistan Customs free to proceed with the Show Cause Notice (SNC) but subject to keeping view of Classificaiton Committee concerned and giving an opportunity of being heard to the plaintiff side.

The bench also ordered that until final order is passed on SCN, the bank guarantee furnished by the plaintiff shall not be en-cashed.

The suit pertain to import of poultry feed and the importer sought exemption not available. This resulted in a dispute  over classification. The goods were however provisionally released against secured bank guarantee with the department.

Mr Ahmed Ali Hussain advocate represented the plaintiff side while customs was represented by Khalid Rajpar Advocate.
