KARACHI: A petition filed by Dur Apparels, Sialkot which imported superior quality polyester fabric was dismissed as not pressed after the petitioner expressed inability to deposit differential amount assessed by Directorate of Intelligence and Investigations (DIT).

The petitioner sought release of the consignment held by the DIT challenging jurisdiction as well as holding it over valuation dispute. The petitioner maintained that imported item is “Polyester Woven Micro Fiber Fabric” and sought release and valuation under HS Code 6004.1000 (US $ 3/kg) under Valuation Ruling 1301 of 2018.

The DIT blocked the consignment on line and sent the sample for lab test which yield that item in dispute is “Brilliant White Stretchable Fiber” (95% Polyester & 5%Lyera) which is classifiable under HS Code 5407.5100 having value of US $ 8.50/kg.

The bench after hearing Khalid Rajpar Advocate representing DIT and counsel for petitioner company ordered provisional release after securing of disputed differential amount with the Nazir of SHC.

As petition came up for hearing, the bench asked the petitioner side that whether they have complied with the order of the court. The counsel expressed inability to deposit the amount assessed by the DIT. The bench after this statement and request of the counsel for petitioner who on instructions said that he is not pressing the petition.

The bench allowing the request dismissed the petition as “not pressed”.
