KARACHI: A cost of rupees 25000 was imposed on a petitioner/importer who sought implementation of ONO passed by Collector Adjudication concealing fact that judgment has been reserved by the Appellate forum.

The bench was hearing a petition filed by Choudhry Steel, importers of iron and steel scrap which moved the court seeking release of their consignment on the basis of the ONO passed by the Collector Adjudication.

Miss Afsheen Aman advocate appearing for the Pakistan Customs at the outset informed the bench that petitioner has concealed material facts. She stated that an appeal has been filed before the Appellate Forum which has reserved judgment. Yet the petitioner filed the instant application. She said that ONO, implementation of which has been sought by the petitioner has been suspended and therefore could not be implemented.

The bench perusing the papers and other documents, dismissed the petition as being misconceived imposing a fine of rupees 25000 on petitioner. The amount was ordered to be deposited in the account of SHC Clinic.
