KARACHI: A customs appellate bench of High Court of Sindh on Friday allowed a petition filed by importer of steel pipes who is also a manufacturer bond licensee.
Imran Iqbal Advocate appearing for the petitioner challenging the demand notice for payment of Warehousing surcharge and penal surcharge submitted that customs department without confronting the petitioner for non-payment of surcharges and without any adjudication proceedings and issuing show cause sent demand notices.
He further contended that despite fulfilling of all legal formalities and requirements under Custom Act 1969 and Custom Rules 2001, the license of manufacturing bond is not being renewed.
The bench after hearing the arguments at length allowed the petition setting aside the impugned demand notice.
