KARACHI: A constitution petition filed by Al-Majeed Ibrahim Steel Industries (Private) Limited and Max Comfort (SMC Pvt) Ltd was dismissed by a custom appellate bench of High Court of Sindh (SHC) for not being maintainable.

The bench heard initial arguments by Adeel Awan advocate, counsel for theĀ  petitioners and asked about maintainability of the petition. The bench also asked that why it shall interfere when there is no cause of action. The dispute is over amount of duty and taxes.

The counsel for petitioner requested the bench that he will not press the petition if the respondents were directed to entertain the request for provisional release of the consignments subject to securing of disputed amount of duty and taxes before the collectorate concerned.

The bench dismissed the petition as not pressed while allowing the petitioner to approach the respondents including Collectors of Custom Appraisement, East and West and Collector of Customs (Imports) Port Muhammad Bin Qasim and agitate their grievances regarding valuation in accordance with law.

The bench also directed the respondents to consider the request of the petitioners for provisional release of the consignments subject to securing of disputed amount of duty and taxes with them.
