KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Umar Sial and Justice Zulfiqar Sangi allowed provisional release of an oil tanker detained for use in transporting smuggled Iranian HSD.

Dost Muhammad, owner of the Hino vehicle TUA 805 moved the court seeking release of the vehicle through counsel Ms Dil Khurram Shaheen advocate.

The vehicle was seized on 21-2-2019 near Mochko, RCD Highway, Hub River road. According to Pakistan Customs, Preventive Collectorate, 14400 litres of HSD was allegedly recovered from cavities.

The confiscation and detention of the vehicle was challenged before appellate authority which passing Order in Original gave option under SRO 499 of 2006 i.e release on payment of fine and penalty.

The department went into appeal and ONO was reversed. This order was then challenged by owner before Special Customs Appellate Tribunal which upheld the order in ONO.

The department challenged the order of tribunal in Special Custom Reference Application 69/2020.

The bench hearing the counsel ordered provisional release of the Hino vehicle while its registration book will remain in custody of the Nazir of SHC till decision in SCRA.
