Supreme Court of Pakistan quashed Presidential Reference against Qazi Fayez Isa and also withdraw show cause notice issued by the Supreme Judicial Council here on Friday.
A full court of SCP headed Justice Umar Ata Bindiyal heard more than a dozen Constitutional Petitions filed by Justice Qazi Fayez Isa, Supreme Court Bar Association of Pakistan and other bar council’s of the country.
The judgment is a majority decision 9-1 as Justice Yahya Afridi dissented and dismissed the petition filed by the petitioner judge who challenged the reference as well as proceedings before the Supreme Judicial Council as being mala fide and revenge against judgment given by petioner Judge in Faizabad Dharna case.
Justice Isa also gave a judgment in suicide bombing case in Quetta which claimed lives of more than seventy lawyers and held sensitive agencies inability responsible for such acts of terrorism.
The SCP also addressed the issue or allegation of London properties owned by the wife of Justice Isa and ordered that a Comnisoner of Income Tax-Inland Revenue shall sent notices to the wife and children of the judge who shall respond to such notices timely. The bench also ordered to decide the tax case within 90 days and to submit a report before SJC for a decision if any action is warranted under Article 209 of Constitution of Pakistan. The detailed order will be passed in due course of time with detailed reasons.
