SHC orders release of Toyota Surf, Indus Corolla

KARACHI: Expressing extreme displeasure over use of detained vehicles by custom officials, an appellate bench of High Court of Sindh said that such officials may be sent to prison.

The bench was hearing a petition filed by owner of a Indus Corolla car model 1997. Ms Dil Khurram Shaheen advocate appearing for the petitioner maintained that it was a legally purchased vehicle and Special Custom Appellate Tribunal has ruled in favor of the petitioner. She told the bench that the vehicle was being used by an officer of Customs Preventive with number plate GS 1756.

Whenever an official needs a vehicle they go and detain one, the bench observed saying that it may consider sending such delinquent officials to jail.

A counsel appearing for customs said that they have filed the SCRA against order of the customs appellate tribunal.

The bench ordering production of the vehicle before the Nazir of SHC put off further proceedings till March 20.

The same bench hearing another petition filed by owner of Toyota Hiace van of 1995 model ordered production of vehicle before the Nazir of SHC.

The same bench also ordered release of a Toyota Hilux Surf. The owner was however restrained from creating third party interest in respect of said vehicle.
