SHC halts coercive recovery in Sales Tax case

KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan on Tuesday stopped Sindh Revenue Board from Coercive recovery.

The bench was hearing a petition filed by one Syed Jawaz Arshad of a manufacturing firm.

According to details, the petitioner maintained that he is a registered manufacturer who imports chemicals used in textile and  leather sector. The company of the petitioner filed sales tax refund cases for the tax year 2011-2012 and refunds to the tune of Rupees 35 Million were granted in its favour. Suddenly the Sales Tax Authorities without any assessment, adjudication or else lodged a FIR on allegation that refund was secured by filing fake invoices.

The bench after a brief hearing while adjourning further proceedings restrained officials from coercive recovery.
