SHC orders seizing officer to be in attendance on Feb 27 Rickshaw ordered to be produced before nazir in cloth case

KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan ordered a custom officer who seized cloth of a petitioner, to be in attendance on Feb 27, next date of hearing in a petition filed by one Hujjatullah and others.

Ryan Zia advocate appearing for the petitioner, a cloth merchant and a rickshaw driver submitted that the petitioner is a cloth vendor having shop at Boulton Market and has purchased a lot of cloth from Jamia Cloth Market. The said cloth was transported to his shop in a rickshaw when it was intercepted by area police. The police later handed over the cloth and rickshaw to the custom authorities who detained the same against a detention receipt.

The counsel said that petitioners apprehend involvement in false and frivolous case ignoring the purchase receipt by custom officials.

The bench after a brief hearing ordered issuance of pre-admission notice for Feb 27 while directing the seizing officer to be in attendance on next date of hearing. The bench also ordered that rickshaw detained by the custom officials shall also be produced before the Nazir of SHC.
