FBR to challenge SHC order in Afghan Transit Sugar case

KARACHI: Federal Board of Revenue on a move by Directorate of Transit Trade Karachi has decided to challenge an order of Custom’s Appellate bench of High Court of Sindh in Constitution Petition CP-D 5593 of 2019 titled Messrs Farid Asif Ltd  versus Federation of Pakistan.

The customs bench on 7-12-2019 allowed the petition directing the respondents to ensure safe transit of the sugar consignments detained by Pakistan Customs on ground of color of the sugar.

Raja Muhammad Iqbal, senior advocate Supreme Court have been nominated to appear for the appellants in CPLA (Civil Petition for Leave to Appeal) be filed before the apex court.

The petitioner side maintains that consignment was destined for Afghanistan and falls under Afghan Transit Trade, hence Pakistan Customs has no jurisdiction to check the quality of the sugar and to determine that whether it is “fit or unfit for human consumption”.
