KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprisinga Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan on Thursday issued contempt notices to alleged contemnors including Saifuddin Junejo Collector Customs (Export), Mrs Moona Baloch, Additional Collector Customs (Export), Aftab DeputyCollector (Export) of MCC Port Muhammad Bin Qasim in an application filed by Balochistan Engineering Works (Pvt) Ltd.

Earlier Rana Shakawat Advocate appearing for the petitioner submitted that legally imported consignments of the petitioner were provisioally released under section 81 of the Customs Act 1969 at LME price by the Collectorate concerned but respondent Export collectorate issued four show cause notices. The alleged contemnors are violating the orders of SHC passed on 10-10-2019 and 24-10-2019.

Today when the contempt application came up for hearing Khalid Rajpar Adovcate, counsel for customs said that respondents have filed applications against orders. He making an appearance in the case opposed the application on ground that it was not possible for the collectorates concerned to implement the order of the court and in the applications filed they have explained all the facts as the petitioner side has concealed material facts. He informed the bench that restraining order was taken in the chambers and not in open court. The petitioner Balochistan Engineering Works has no quota and it was a purchaser. He said subsequently respondents have issued show cause after making contravention reports. He also prayed to the court to recall the order in view of the circumstances of the case.

The bench however ordered issuance of contempt notices to respondents for 12-11-2019 when already this petition is fixed for hearing.
