SHC restrains customs from arresting alleged financier of unclaimed consignment
KARACHI: The custom officials were restrained from arresting an alleged financier of an unclaimed imported consignment.
The order came from a customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan who heard Zain Jatoi advocate appearing for petitioner/accused Muhammad Aslam. The counsel contended that the petitioner was nominated in a new FIR 11/2019, dated 12-10-2019. No goods declaration was filed for the said consignment and petitioner was implicated on presumption that he is the financier. The petitioner is neither an importer or consignee, nor the IGM is in his name and no other custom document show his name.
The counsel relied of a recent order of this bench in a petition filed by United Marine Agency and said that petitioner be protected against harassment or arrest. The bench while issuing pre-admission notice restrained the customs from arresting him till next date of hearing. The bench also asked the petitioner to cooperate with the prosecution.
