SHC restrains customs from coercive recovery of rupees 168 million

KARACHI: A show cause notice issued to the Spark World was suspended by a custom appellate bench of High Court of Sindh comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan.

The petitioner company through Franklin Law Associates challenged the show cause as well as notice for recovery of rupees 168 millions against LCD parts imported by them.

The dispute pertains to consignments LED parts and panels of Samsung Brand released in June and July this year. The petitioner also submitted that it filed GD as per SRO 565/2006 while custom authorities are adamant on deciding the liabilities under VR 1089. The action against the petitioner was being taken without adjudication and on consignments which have already released, contended the counsel.

The bench after hearing while suspending show cause notice also restrained the respondents from coercive recovery till next date.
