SHC issue notices in petition by another textile goods importer

KARACHI: Pre-admission notices were issued for Oct 04 to Deputy Attorney General and respondent customs officials including Directorate of Intelligence and Investigations (DIT) here on Thursday in a petition filed by Iqbal and Sons.

Earlier an appellate bench comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan heard a counsel from Franklin Law Associates appearing for the petitioner company which imported a consignment of textile fabrics.

The counsel submitted that respondent custom officials held the consignment at the instigation of the D.I.T and consignment is being held without assigning any reason.

He further maintained that D.I.T has no jurisdiction over consignment at port during assessment. He prayed to the court to direct the custom authorities for processing the Goods Declaration filed by the petitioner/importer.

The bench while issuing pre-admission notices to the respondents as well as DAG also ordered processing and release of consignment if no contravention or violation of custom laws was found. The bench also restrained the respondents from any coercive action against the importer/petitioner till next date of hearing.

According to sources, the illegal hold was being placed to give leverage to smugglers who uses Torkham border point. This would reduce the legal import and encourage smuggling, said the disgruntled petitioner adding that government policies are back firing now due to acts by custom officials.

The petition was tagged with a number of identical petitions to be heard in the first week of October.
