KARACHI: Justice Muhammad Junaid Ghaffar of High Court of Sindh on Monday allowed an application filed by Supreme Terminal Pvt Limited, Port Qasim and Supreme General Trading L.L.C Dubai in a suit filed by them against Qasim International Container Terminal (QICT), Modern Terminal Operator, an Off Dock Terminal Operator, Qasim Freight Station, Park Shaheen Container Services (Pvt) Limited, DMK Logistics (Pvt) limited, Chairman FBR, Collectors of Custom Import, Exports and Chairman Port Qasim Authority.
Khalid Javed Khan appearing for the plaintiffs maintained that they were granted license to operate an Off Dock Terminal by FBR while plaintiff 2 was alloted a piece of land BBA/SB/03 admeasuring 20 acres South West Industrial Zone by Port Qasim Authority and both entered into a joint venture for same purposes.
The defendant no 1, QICT is port terminal operator at PQA. The defedant no 1 on the basis of some legal notice from defendant no 2 refused to load such cargo on the vessels on behlaf of the plaintiff hence the suit was filed.
Khalid Rajpar advocate appearing for the Customs Collectorate conceded that the plaintiffs have a valid license and therefore have the right to operate an Off Dock Terminal.
The learned single after hearing the counsel from both sides at length allowed the injunction application filed by the plaintiffs holding that balance of convenience is in favor of the plaintiffs and that if the injunction application is not allowed they will suffer irreparably.
