KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Monday ordered issuance of notices to the Chairman FBR, Commissoner IRS and Collector Customs (Appraisement) Group IV, Karachi while hearing a petition challenging black listing of STRN on the basis that manufacturing unit of the petitioner is ill equipped to commensurate with the volume of importer textile.

The bench earlier heard Iftikhar Hussain advocate representing petitioner Fateh Limited, a public limited company importing textile products. The order of black listing was passed on 30-5-2019 after a visit to the industrial manufacturing unit of the petitioner company during which the team from IRS found that no plant or heavy machines were found at the claimed manufacturing unit and thus petitioners cannot claim concession as being manufacturer. The custom officials on the basis of the said black listing and report about the manufacturing unit detained the consignments of the petitioner company disallowing release of the consignments under section 81 of the Customs Act 1969.

The counsel appearing for the petitioner today submitted that pending decision that whether the petitioner has a working, suitable sized manufacturing unit, the petitioner is ready to pay the disputed amount of Sales tax or duties etc.

The bench allowed the request while issuing notices to the respondents for July 10.
