SHC reply from IRS, custom officials in petitions challenging blocking of bank accounts

KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Wednesday asked IRS, Pakistan Customs to reply that under what law and jurisdiction they have blocked the bank accounts of petitioners.

The bench was hearing identical petitions filed by Bashir Ahmed and Muhammad Nabi challenging blocking of their bank accounts on pre-text that they have availed benefit of SRO 1125 which was applicable to a manufacturing unit alone.

A counsel from Franklin Law Associates appearing for the petitioners submitted that the petitioner purchased the fabric from open market in Sept, Oct, 2018. They are not the beneficiaries of any exemption under the said SRO. The blocking of the accounts virtually stopped all business activities by the petitioners, the counsel contended.

The bench today after hearing arguments from both sides at length ordered IRS and Customs to file replies stating that under which law and jurisdiction they have blocked the bank accounts of the petitioners. The bench later deferred further proceedings till April 29.
