SHC summons ADC, MCC East in petition by Humak Engineering

KARACHI: Non implementation of an order of SHC’s custom appellate bench landed ADC, of Pakistan Customs, Model Customs Collectorate East into trouble as he was ordered to appear person on March 25.


The bench comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi hearing a petition filed by Humak Engineering Private Limited an order passed by the bench on 28-2-2019 was no implemented.

According to petitioner side they imported floor mounted and split air-conditioners and filed a GD. The custom officials objected to the discrepancy in the amount of LC and Commercial Invoice.

The petitioner obtained a corrected invoice to rectify the difference  but in the mean while a show cause was issued. The adjudicating authority accepting the plea of importer/petitioner set aside the show cause passing order in favour of Humak Engineering.

As implementation of Ono was denied, the petitioner moved the SHC which ordered provisional release of the consignment after payment of disputed amount by the importer.

The court was however told that the official concerned is not implementing the order of the bench. The bench after this statement  directed Collector of Customs, MCC East to ensure appearance of the ADC concerned before court on March 25.
