KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi on Thursday ordered Pakistan Customs to release a consignment of ladies purses and suit cases within two days.
The bench also asked the petitioner company “Super House Pvt Limited” to file a contempt application if the respondent officials fails in complying with the order of the court.
The controversy pertains to exemption of Sales Tax to the tune of six per cent under two SRO’s 1125 of 2012 and 777 of 2018. The court on a previous hearing after hearing a lawyer from Franklin Law Associates has ordered the respondent custom officials to implement the court’s order in “letter and spirit”, yet the release was delayed. The respondents instead of releasing the consignment under section 81 of the Customs Act said that consignment could be released under section 83 (b) which involves imposition of fine and penalty both.
The bench expressing dismay over noncompliance of its earlier orders directed te respondents to release the consignment in two days. The bench seeking a report fixed March 06 for hearing while directing the petitioner to file contempt application in case respondents fail to implement court’s order.
