SHC issue notice in case of tankers detained since 2012

KARACHI: Justice Junaid Ghaffar of High Court of Sindh (SHC) ordered issuance of notices to Pakistan Customs, Preventive, Hyderabad and other defendants in a suit filed seven year back in 2012.

Kashif Masood of SRA Enterprises filed the suit challenging show cause notices issued in respect of three oil tankers detained allegedly after recovery of Iranian diesel.

The suit (765 of 2012) was pending since seven years. The single judge heard an application by an intervenor Habib Baksh who claimed to have hired the oil tanker on rental. Ms Dil Khurram Shaheen advocate arguing the application prayed for vacation of the stay order issued and operative in favour of plaintiff SRA Enterprises on ground that she wanted the custom authorities to proceed on show cause notice and let the controversy be decided as delay is causing hardship to the  applicant/intervenor.

The single judge after hearing the counsel for applicant as well as suit filed ordered issuance of notices to defendants for Feb 15.
