KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Wednesday adjourned hearing of a petition pertaining to release of an Asphalt Paver machine for today (Thursday) while summoning files of all identical cases.
The bench was hearing a petition filed by Minhas Construction Company represented by Miss Dil Khurram Shaheen advocate who submitted that in identical cases the consignment in dispute has been released but the petitioner was being discriminated.
The imported has filed the GD under same PCT Heading, same PSI certificate and like others no model or year is mentioned while the consignment landed on 3 days before cut-off date, she contended.
The bench after this statement expressing displeasure summoned case files of petitions of identical nature in which importers were given benefit of provisional release and fixed petition for further hearing today (Thursday).
The same bench in another case disposed of the petition as “not pressed” after counsel for Port Qasim Masooda Siraj stated that the Asphalt Paver machine in question has been released by Port Qasim Collectorate. She also stated that a delay detention certificate has also been issued in favour of the petitioner/ importer after deposition of 75 per cent demurrage with the shipping company.
