KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Wednesday fixed Jan 12 to decide a petition in respect of Asphalt Paver Machine.

The bench was hearing a constitution petition filed by Sachal Construction Company. Ms Dil Khurram Shaheen advocate appearing for the petitioner company said that respondent Custom officials are demanding PSI certification and another that the imported machine is Euro II compliant. The demand from custom was raised in a letter referring to para 9 (1) of (6) which pertains to commercial importers while consignment in dispute was imported by the construction company.

She also contended that paver machines in dispute were imported many months back. She contended thatr a Goods Declaration was filed by petitioner on 14-10-2017 while Bill of Landing dated Sept 01, 2017. The letter from Collector Customs was sent later hence not applicable to the petitioner contended counsel for petitioner.

The bench said that as an interim measure, the consignment could be released. Kashif Nazeer Advocate appearing for the respondents sought time to seek instructions. The bench allowing the request put of further proceedings till Jan 12.
