KARACHI: A Customs appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Omar Sial on Tuesday issued notices for Dec 15 to the respondents including Chief Collector (CC) Customs in a petition challenging a circular issued by the CC denying benefit of “provisional release” to importers/applicants.
The bench was hearing a petition filed by Zaki Industries which imported a consignment of cosmetics and toilet soaps. A counsel from prominent law firm “Franklin Law Associates” representing the petitioner side argued before the bench on Tuesday that the circular issued by the Chief Collector Customs, Karachi was in violation of principle laid down by the court in caseknown as Jahangir case, PTC 2016, 702.
The petitioner is entitled to relief under the said case law, the counsel argued adding that circular is multiplying the losses of the importers while government is deprived of duty and taxes amounting to millions of rupees.
The bench after hearing initial arguments ordered issuance of notices to the respondent custom officials for Dec 15.
