KARACHI : A customs appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Omar Sial ordered release of a dumper truck impounded by the Hyderabad Customs. The bench earlier heard Ms Dil Khurram Saheen advocate appearing for petitioner Long Khan. She maintained that every vehicle has a "cavity" and restrictions apply on "false cavity" alone. She maintained that as per show cause and other documents, the dumper truck was detained for having a "cavity" and no where it was alleged that the vehicle had a "false cavity" hence SRO 499 of 2009 does not apply. She prayed to the court to order release of the vehicle on ground that custom authorities have illegally detained the vehicle, sole source of income of the petitioner. The bench after hearing the counsel for Hyderabad custom authorities ordered release of the dumper truck. The same bench also heard a number of more new petitions against imposition of Regulatory Duty (RD). Senior most lawyer Kamal Azfar advanced arguments in a petition after which the bench deferred further proceedings till Nov 16 when Additional Attorney General Salman Talibuddin will make arguments on behalf of federal government, main respondent in hundreds of petitions against RD.
