SHC declines petition against recovery, CIT ordered to decide appeal in 30 days

KARACHI: An appellate bench of High Court of Sindh (SHC) comprising JusticeIrfan Sadaat Khan and Justice Arshad Hussain Khan on Monday disposed of a petition filed by Nelson Paints Ltd praying to the court to restrain RTO from alleged coercive recovery.

When the petition came up for hearing, Ms Dil Khurram Shaheen advocate appearing for the respondent  RTO II, submitted that while the petitioner’s appeal pending adjudication there is no bar preventing the tax officials from enforcing recovery.

The bench agreed to the arguments advanced by the counsel for department and while disposing off the petition ordered the Commissioner Income Tax (CIT) to decide the appeal within 30 days.
