KARACHI : A petitioner seeking release of an oil tanker was warned by a n appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Arshad Hussain Khan for making  a statement belied by Assistant Commissioner Customs Hyderabad.

As the petition filed by Momin Khan was taken up, Assistant Commissioner Mumtaz Ali appearing along with Kashif Nazeer advocate submitted that he has passed the detailed order after petitioner’s attorney appeared before him. He also submitted that incorrect information was given to the court regarding non implementation of order passed on a previous date.

The counsel for petitioner, MS Dil Khurram Shaheen advocate rebutted the statement and said  AC Custom, Hyderabad is becoming personal and delaying release of the tanker. She informed the court that Order in Original has been passed by the competent appellate forum which has ordered release of the oil tanker against payment of a fine of rupees 200,000 and redemption fine at a rate of 20 per cent.

The court observed that if can summon an official/officers it can also summon the Petitioner or his Attorney. The court warned both the Petitioner as well as his attorney from making any incorrect statement or action will be taken against them also.

The bench then asked the counsel for Petitioner to file a rejoinder if it controverts the para-wise comments. The bench then deferred further hearing till June 01.
