KARACHI: A division bench of High Court of Sindh (SHC)  declined hearing a constitutional petition in an alleged smuggling case. The bench was hearing a petition filed by Mushtaq Ahmed through counsel Ms Dil Khurram Shaheen advocate.

As she addressed the court saying that items in dispute were not smuggled one, Justice Munib Akhtar hearing the bench stopped her saying that according to a judgment passed by him, the Special Customs Reference Application lie before Balochistan High Court. He pointed out that in this case too proceedings commenced in Balochistan’s territorial jurisdiction. If we pass some orders and BHC passess another then there will be conflicting judgments, the bench said putting of hearing indefinitely on the request of petitioner side.

The same bench while taking up a petition filed by one Ehsan ullah for release of oil tanker seized by the Custom authorities for carrying smuggled High Speed Diesel, the bench fixed Feb 09 as next date of hearing.
