KARACHI: Faisal Ghani CEO of M/s Franklin Law Associates has been able to make an out of the court settlement and got the NTN/USER ID of M/s Faisal Trading restored, which had been blocked after an FIR was lodged against the company.
MCC Appraisement West lodged an FIR against M/s Faisal Trading, Karachi for allegedly attempting to evade duty and taxes through mis-declaration.
FIR was lodged against Faisal Aftab of M/s Faisal Trading, as the importer allegedly in connivance with the shipper and other associates under-declared the weight of consignment to evade government’s legitimate revenue. Subsequently, NTN/User ID of the importer was blocked.
Faisal Ghani of M/s Franklin Law Associates representing the importer, approached Collector MCC Appraisement West Farid Iqbal Qureshi and Additional Collector Saleem Memon and convinced the officers that blocking of User ID and NTN was illegal.
The officers were informed that R&D created a demand if Rs10.04 million against the importer alleged to have been short levies in the case of 12 GDs filed by the importer M/s Faisal Trading and the ID was blocked.
Faisal Ghani mentioned that the demand was based on assumptions and whimsical grounds. It is settled law that no recovery demand can be created against the importer without following the process of law as per section 32 and 179 of Customs Act, 1969.
MCC Appraisement West officers were convinced with the arguments of Faisal Ghani and ordered immediate restoration of NTN and User ID of M/s Faisal Trading.
